Nesta sexta-feira (16), ocorreu a terceira audi\u00eancia da comiss\u00e3o de concilia\u00e7\u00e3o criada pelo Ministro Gilmar Mendes, relator da ADPF n\u00ba 984 e da ADI 7191. A determina\u00e7\u00e3o tem o objetivo buscar converg\u00eancia entre os estados e o governo federal sobre as novas altera\u00e7\u00f5es do ICMS de combust\u00edveis, energia el\u00e9trica, comunica\u00e7\u00e3o e transporte coletivo inseridas pela Lei Complementar192\/2022 e Lei Complementar 194\/2022.<\/p>\n

Reconhecendo o que indica a Constitui\u00e7\u00e3o ao estabelecer que compete aos estados e Distrito Federal definir se a modalidade da al\u00edquota do ICMS incidente em combust\u00edveis e lubrificantes ser\u00e1 ad rem (espec\u00edfica por unidade de medida) ou ad valorem (percentual sobre o valor da opera\u00e7\u00e3o), as partes acordaram que poder\u00e1 haver aperfei\u00e7oamento da LC 192\/2022, no intuito de reconhecer a autonomia dos estados para decidir sobre a modalidade de al\u00edquotas, bem como para respeitar a autonomia de reajustes de pre\u00e7os necess\u00e1rios. Com isso, poderiam ser alterados o art. 3\u00b0, V, “b” da LC 192\/22 e $4\u00b0, art. 6\u00b0 da LC n\u00b0 192\/22.<\/p>\n

A pr\u00f3xima audi\u00eancia se realizar\u00e1 no dia 26 de setembro (segunda-feira), \u00e0s 14h, no Supremo Tribunal Federal em Bras\u00edlia, onde dever\u00e1 ser tratado o tema da tributa\u00e7\u00e3o da Tust<\/em> e da Tusd<\/em> na energia el\u00e9trica. <\/p>
