O ministro do Supremo Tribunal Federal (STF) Luiz Fux autorizou os estados a cobrarem o ICMS sobre a tarifa\u00e7\u00e3o na transmiss\u00e3o e distribui\u00e7\u00e3o de energia (Tust e Tusd). Nessa quinta-feira (09), ao conceder medida cautelar suspendendo a exclus\u00e3o das tarifas na cobran\u00e7a do imposto sobre o setor de energia el\u00e9trica definido pelo inciso X do art. 2 da LC 194\/2022, o magistrado reconheceu que a Uni\u00e3o n\u00e3o tinha compet\u00eancia constitucional para legislar sobre o tema tribut\u00e1rio, da al\u00e7ada exclusiva dos estados.<\/p>\n

A decis\u00e3o do ministro vai ao encontro da tese defendida pelos estados. O ICMS, conforme determinado pelo constituinte, deve incidir no valor total da opera\u00e7\u00e3o, n\u00e3o cabendo desmembramento da base de c\u00e1lculo. <\/p>\n

\u201cOutrossim, sob o aspecto material, o uso do termo \u201copera\u00e7\u00f5es\u201d remete n\u00e3o apenas ao consumo efetivo, mas a toda a infraestrutura utilizada para que este consumo venha a se realizar, isto \u00e9, o sistema de transmiss\u00e3o da energia<\/em>\u201d , destacou o ministro.<\/span><\/p>\n

Outro ponto ressaltado pelo magistrado foi o impacto sobre as receitas de estados e munic\u00edpios. O impacto anual seria de R$ 33 bilh\u00f5es na arrecada\u00e7\u00e3o do ICMS, colocando em risco  a manuten\u00e7\u00e3o de servi\u00e7os p\u00fablicos essenciais \u00e0 popula\u00e7\u00e3o brasileira.<\/p>\n

Nesta semana, o ministro da Fazenda, Fernando Haddad, em encontro com governadores que, ent\u00e3o, representavam o F\u00f3rum dos Governadores, apoiou a suspens\u00e3o da exclus\u00e3o da TUSD\/TUST como parte do acordo entre estados e Uni\u00e3o pelas compensa\u00e7\u00f5es da LC 192 e 194.<\/p>\n

A decis\u00e3o<\/a> ainda ser\u00e1 levada \u00e0 an\u00e1lise dos demais magistrado do STF, em sess\u00e3o virtual, com previs\u00e3o de realiza\u00e7\u00e3o entre 24 de fevereiro \u00e0 03 de mar\u00e7o.<\/p>\n
